Landlord or Tenant? Who’s Responsible for a Blocked Drain in a Rental Property

A blocked drain in a rented home tends to raise two questions at once: who has to sort it, and who has to pay. The answer depends on what caused the blockage and where in the system it sits, so it’s worth understanding the basics before a call to the letting agent turns into an argument.

The general rule

As a general position in England and Wales, a landlord is responsible for maintaining the structure and exterior of a property, which includes the drains, gutters and external pipes. That means a landlord is usually expected to arrange and pay for repairs to a blocked or damaged drain that’s part of the property itself.

Where tenants can be liable

The exception is misuse. If a blockage is caused by something a tenant has put down a sink or flushed down a toilet, such as wipes, sanitary products, cooking fat, or food waste, a landlord can reasonably ask the tenant to cover the cost of clearing it. This is usually set out, or at least implied, in the tenancy agreement.

A few common scenarios

  • Tree roots or a collapsed pipe: almost always a landlord repair
  • Fat, wipes or food waste blocking a kitchen or bathroom drain: often a tenant cost
  • A blockage in a shared drain serving several rental units: down to whoever manages the building, and possibly the water company for the section beyond the boundary
  • Recurring blockages in the same spot: worth a proper survey rather than repeated call-outs, since it usually points to a structural issue
